Benefits begin after the first successful payment. Benefits run on a 12-month cycle and do not roll over. Periodontal upgrades are allowed anytime; downgrades occur at annual renewal with doctor approval. Youth plans transition to Adult Preventive Care at the renewal following age 13. Cancel with 30 days’ written notice. Annual-plan refunds are prorated using standard retail fees; no refund is issued when completed care exceeds payments. Less than 24 hours’ cancellation notice may forfeit the scheduled benefit or incur a $50 fee to preserve it.
Ensure clear separation from insurance. In accordance with New Jersey Department of Banking and Insurance (DOBI) guidance, this framework constitutes a Discount Medical Plan Organization (DMPO) or a direct provider agreement. It must explicitly state on all documentation: “This plan is an in-office discount design, NOT dental insurance, and cannot be combined with any other insurance policy.”
All promotional materials must prominently display: “This plan is only valid at Cosmetic Dentist of Paramus and does not make payments directly to dental providers or cover specialist referrals.”
In alignment with NJ consumer protection laws, monthly subscriptions must clearly disclose the recurring draft mechanism. Written or digital consent via a signed authorization form is required. Annual plans require a 30-day email reminder before auto-renewal charges execute.
Membership fees are recognized as gross income when received if accounting on a cash basis, or deferred as unearned revenue under an accrual basis. In New Jersey, direct dental care services and internal memberships are generally exempt from state sales tax.
Patients cannot use both the membership plan and traditional dental insurance simultaneously for the same procedure. If a member gains employer-sponsored insurance, they can transition off the plan at their next renewal or cancel subject to the 30-day notice provision.
